All services provided by Trail Explorer ("we" "us" "our" "the company") are sold to the client ("you") subject to the following conditions

Coaching Terms and Conditions
The following terms and conditions are relevant to all coaching services booked through Trail Explorer, including mountain biking, climbing, and paddle sports activities. By booking through Trail Explorer, you agree to the Terms and Conditions outlined below.
Booking
To secure your booking, payment must be made in full either via the online booking service or through other agreed payment methods. Confirmation cannot be secured until payment has been received. We operate on a first-come, first-served basis. Once payment is received and the booking form is completed, a contract shall exist between you and Trail Explorer.
Cancellation
By You: If you wish to cancel your booking, this must be done at least 2 weeks prior to the start date of your booking. Bookings cancelled 2 weeks or more before the start date will be refunded 80% of the total booking cost. Bookings cancelled within 2 weeks of the start date will not be refunded. However, we will attempt to accommodate an alternative date for private bookings, subject to availability. Please note, this may not always be possible.
By Us: We retain the right to cancel any booking if circumstances beyond our control arise, such as adverse weather conditions, natural disasters, fire, or operational issues. Public sessions/courses require a minimum number of participants to run, and if this number is not met 7 days prior to the session/course, it may be cancelled. Alternative session/course dates will be offered, or a full refund will be provided if preferred. Trail Explorer will not be liable for any other expenses incurred due to the booking.
Your Responsibilities
Adventure sports can be hazardous and may involve discomfort. Clients are responsible for making their own decisions and acting within their abilities at their own risk. Trail Explorer cannot be held liable for client actions or safety during the session/course. Clients must bring and wear appropriate clothing for the environmental conditions. When making your booking, you are responsible for informing us of any medical conditions or medications that could affect your safety during the activity.
Mountain Biking
It is your responsibility to ensure that your mountain bike is in good working order. If mechanical issues arise during the session/course, you are responsible for addressing them or seeking assistance. You must also bring and wear appropriate protective clothing, including a helmet and suitable footwear, throughout the session/course. Failure to comply with this requirement will result in the cancellation of the session with no refund issued. We recommend wearing gloves, knee pads, and any additional protective gear you deem necessary.
Climbing
For climbing sessions, you must wear suitable clothing for the activity and the weather conditions. Appropriate footwear is essential, and we recommend bringing climbing-specific shoes. If you are renting equipment, it is your responsibility to ensure it is used properly and that it meets safety standards. Failure to wear suitable footwear and clothing will result in the session being cancelled with no refund.
Paddle Sports
For paddle sports sessions, you must wear suitable clothing for the activity, including a buoyancy aid (if required), a wetsuit or drysuit (based on weather conditions), and appropriate footwear. We will provide equipment where necessary, but it is your responsibility to ensure it fits properly and is in good condition.
Health and Fitness Requirements
Participants should be in good health and physically capable of undertaking the chosen activity. If you have any concerns about your ability to safely participate, please consult a doctor beforehand. Trail Explorer reserves the right to refuse participation if we believe the activity is unsuitable for a client due to health or fitness concerns.
Behavior and Conduct
Participants are expected to behave in a manner that ensures the safety and enjoyment of all involved. Failure to follow instructions, disruptive behavior, or actions that put others at risk may result in removal from the session, with no refund issued.
Emergency Procedures
In the event of an emergency, our instructors are trained in first aid and have access to emergency services. You will be briefed on the location and emergency procedures at the start of the session.
Use of Photographs and Videos
Trail Explorer reserves the right to take photographs or videos during sessions, which may be used for promotional purposes. If you do not wish to be photographed or filmed, please notify us before the session begins.
Group Bookings
For group bookings, the lead booker is responsible for ensuring all participants are aware of the terms and conditions, and for the behaviour and safety of the group during the session.
Weather-related Issues
Trail Explorer reserves the right to reschedule or cancel sessions due to unsafe weather conditions (e.g., extreme storms, high winds, or poor visibility). You will be notified as early as possible, and alternative dates or a full refund will be offered.
Equipment Hire
If you are hiring equipment from Trail Explorer, you are responsible for its care and return. Any damage or loss of equipment will be charged to the client at replacement cost. Equipment must be returned by the agreed time, or additional charges may apply.
Force Majeure
Trail Explorer shall not be liable for failure to deliver services if such failure is caused by events outside of our control, including but not limited to force majeure events like natural disasters, pandemics, government restrictions, or strikes.
Our Responsibilities
Our sessions/courses are designed with participants' safety, enjoyment, and needs in mind. Each session may be adapted to suit the group. We may suggest alternative locations for certain activities.
We accept no responsibility for loss or damage due to client actions or any unforeseen events beyond our control. We also accept no responsibility for any damage to equipment, theft, or injury to the client during a session/course.
Client Insurance
All participants are strongly advised to have adequate insurance to cover themselves for the risks associated with the activity.
Complaints
If you have a complaint, please bring it to our attention as soon as possible. Complaints can be made in writing via email or other communication methods and will be resolved to the satisfaction of all parties involved.
Under 18s
Participants under the age of 18 must be accompanied by a parent or legal guardian. By booking a session/course for someone under 18, you (the parent or guardian) agree to assume all responsibility for your child's participation and any associated risks.

Guiding Terms and Conditions
The following terms and conditions are relevant to all guiding services booked through Trail Explorer, including mountain biking, paddle sports, and climbing activities. By booking through Trail Explorer, you are agreeing to the Terms and Conditions outlined below.
Booking

Public sessions/courses require a minimum number of participants to run, and if this number is not met 7 days prior to the session/course, it may be cancelled. Alternative session/course dates will be offered, or a full refund will be provided if preferred. Trail Explorer will not be liable for any other expenses incurred due to the booking.

You are required to ensure you are in adequate physical health and have the necessary fitness level to participate in the chosen activity. If you are unsure about your ability to safely engage in the activity, please consult with a medical professional prior to booking.
Behaviour and Conduct
Participants are expected to behave in a manner that ensures the safety and enjoyment of all involved. Failure to follow instructions, disruptive behavior, or actions that put others at risk may result in removal from the session, with no refund issued.
Weather-Dependent Adjustments
In the event of unfavorable weather conditions, we may modify the planned route, activity, or difficulty level to ensure safety. If the conditions are deemed unsafe, we will either reschedule the session or offer an alternative activity.
Assumption of Risk & Waiver
By booking a session with Trail Explorer, you acknowledge the inherent risks involved in the activity, including but not limited to injury or damage, and agree to waive any claims against Trail Explorer, its staff, and affiliates in the event of injury, loss, or damage during the activity.
Skill Assessment
Trail Explorer reserves the right to assess the participant's skill level before beginning the activity. If a participant is deemed unfit for the session, an alternative session or refund may be offered at the discretion of Trail Explorer.
Additional Costs
Please be aware that additional costs may apply to certain sessions, including but not limited to parking fees, permits, or transportation to remote locations. Any such fees will be disclosed in advance.
Equipment Damage or Loss
Participants are responsible for any equipment hired or provided by Trail Explorer. If equipment is lost, damaged, or returned in an unsatisfactory condition, the participant will be liable for the cost of repair or replacement at the discretion of Trail Explorer. Equipment must be returned by the agreed time, or additional charges may apply.
Session Duration & Timeliness
Sessions will begin promptly at the scheduled time. If a participant is late, the session may be shortened to accommodate the schedule. Sessions will not be extended for tardiness, and no refunds will be given for missed time.
Emergency Procedures
In the event of an emergency, our guides are trained in first aid and have access to emergency services. You will be briefed on location-specific emergency procedures at the start of the session.
Use of Photographs and Videos
Trail Explorer reserves the right to take photographs or videos during sessions, which may be used for promotional purposes. If you do not wish to be photographed or filmed, please notify us before the session begins.
Group Bookings
For group bookings, the lead booker is responsible for ensuring all participants are aware of the terms and conditions and for the behaviour and safety of the group during the session.
Under 18s

If you have a complaint, please bring it to our attention as soon as possible. Complaints can be made in writing via email or other communication methods and will be resolved to the satisfaction of all parties involved.
This updated version includes the additional clauses for physical fitness, risk waivers, weather adjustments, equipment responsibilities, and other important details. This will help further clarify expectations and responsibilities for both you and your clients.
Holidays
The following terms and conditions set out under the heading "holidays" are relevant but not limited to all guiding services booked through Trail Explorer. By booking through Trail Explorer you are agreeing to the Terms and Conditions set out below.
Booking
To secure your booking, 20% of the total holiday cost must be paid and the booking form completed. Confirmation cannot be secured until payment has been received. We operate on a first come first served basis. Once payment has been received and completion of the booking form has been made, a contract shall then exist between you and Trail Explorer. The remaining balance must be paid 6 weeks or more prior to the start date of the holiday unless otherwise stated on the event booked. If payment has not been made within this timeframe, Trail Explorer retains the right to cancel the holiday. Bookings made within 6 weeks of the start date must be paid in full and are non-refundable. However, we will be fair and treat each booking on a case-by-case basis, and a decision will be made at our discretion.
Cancellation
By you: If you wish to cancel your booking, this must be done 6 weeks or more prior to the start date of your booking. Bookings cancelled 6 weeks or more prior to the start date will be refunded 50% of the total booking cost. Bookings cancelled within the 6 weeks leading up to the start date of the booking will not be refunded. However, we will try to accommodate an alternative date if you wish to change the date booked for private bookings. Please note, this may not always be possible.
By us: We retain the right to cancel any bookings made if there are circumstances beyond our control. For example, adverse weather conditions, natural disasters, fire, and operational reasons. This could be done last minute. Alternative routes or activities can also be made for any of the reasons stated in the previous sentence. Holiday bookings that are not private bookings require a minimum number of participants to operate, and if this number has not been met 3 weeks prior to the holiday, it can be cancelled. Alternative holiday dates will be offered to the client. If unsatisfied, a full refund will be made. Trail Explorer will not be liable for any other expenses you have incurred as a result of the booking made.

Trail Explorer cannot be held liable for the client's actions and safety during the holiday. Clients must bring and wear appropriate clothing for the environmental conditions. At the time of making the booking, it is your responsibility to make us aware of any medical conditions or medication that could put you at risk during the activity.
Mountain Biking: It is your responsibility to ensure you arrive with an appropriate mountain bike that is in good working order. If mechanical issues arise during the session/course, it is your responsibility to correct them or seek assistance in doing so. Clients are also required to bring appropriate protective clothing. A helmet and appropriate footwear must be brought by you and worn throughout the session/course whilst riding a bicycle. Failure to do so will mean you will not be able to ride, and no refund will be issued. It is recommended that clients also wear gloves and knee pads and any other form of protective clothing they would like to wear.
Our responsibilities
Our holidays are designed with the participants' safety, enjoyment, wants, and needs in mind; thus, each holiday may vary to suit this. We may advise an alternative destination or route to suit you.
We accept no responsibility for any loss or damage due to the actions of the client or any unforeseen events beyond our control. We also accept no responsibility for any damage to equipment, theft, or injury to the client during the holiday or when bikes are being transported by vehicle.
Logistics
Transfers – One pick-up unless stated, waiting time for other clients' pick-up, certain transfer locations.

Client insurance
All those who participate in a holiday are strongly advised to have adequate insurance to cover themselves for the risks associated. Your insurance should cover but is not limited to injury, damage to baggage and equipment, and cancellation.
Complaints
If you have a complaint, please bring it to our attention as soon as possible. Complaints can be made in writing by email and will be resolved to the satisfaction of all parties involved. If unsatisfied, further complaints should be made within 10 working days.
Additional Terms
Weather-related cancellations and adjustments
In the event of unsafe weather conditions (e.g., thunderstorms, high winds, extreme temperatures), we reserve the right to modify or cancel activities for safety reasons. We will offer alternative dates or activities where possible, but no refund will be issued if an activity is cancelled due to weather.
Minimum Fitness or Experience Requirements
You should be in reasonable physical condition and have the necessary experience to participate in the selected holiday activities. If you have any concerns regarding your fitness or experience, please contact us before booking. We reserve the right to refuse participation if we feel that your level of fitness or experience is insufficient for safety reasons.
Equipment Rental and Responsibility
If you are renting equipment from us (e.g., bike, helmet, paddle), you are responsible for the care and maintenance of the equipment during your holiday. Any lost or damaged equipment may be charged at full replacement cost.
Health and Safety Requirements
Trail Explorer will provide a safety briefing at the start of each activity. You are required to follow all safety guidelines and instructions provided by your guide. Failure to adhere to safety guidelines may result in removal from the activity without refund.
Alcohol and Drug Policy
Alcohol or drug consumption is strictly prohibited during activities. Any participant who appears to be under the influence will not be allowed to participate and will forfeit their booking without refund.
Liability for Personal Property
Trail Explorer is not responsible for any loss, theft, or damage to personal property during the holiday, including but not limited to bikes, clothing, equipment, or electronics.
Group Size and Special Requests
Group sizes may vary depending on the holiday package. If you have specific dietary or accommodation requests, please inform us at the time of booking so we can accommodate your needs.
Emergency Procedures
In the case of an emergency, our guides are trained in first aid. In the event of a serious injury, we will contact emergency services immediately. It is your responsibility to ensure that any medical conditions are disclosed to us beforehand so that we can provide the best possible care in the event of an emergency.
Photography and Social Media
Trail Explorer may take photographs or video footage during your holiday for promotional purposes. By booking, you consent to your image being used in marketing materials, including social media, unless otherwise specified.
Force Majeure Clause
Trail Explorer will not be liable for any failure or delay in performance under this agreement due to causes beyond our reasonable control, including but not limited to acts of God, government actions, pandemics, and other unforeseen events.

Store Terms and Conditions
The following terms and conditions ("Terms") apply to all products purchased through Trail Explorer, whether through our online store or in-person at our physical location. By making a purchase from Trail Explorer, you agree to the Terms outlined below.
The Contract
Once your order has been accepted by us and we have received full payment for the products you have ordered, and they have been dispatched or collected from our physical store, a contract shall exist between you and Trail Explorer. If we are unable to accept your order, we will inform you as soon as possible and issue a full refund.
Goods

Product Images: Images of products are for illustrative purposes only. Actual products and packaging may vary slightly from the images shown on our website or in-store displays. While we strive to provide the most accurate representations, there may be slight differences in colour and design.

Product Descriptions: We reserve the right to alter the description of any product if necessary. All weights and sizes are approximate and provided as a guide.

Pricing and Descriptions: We reserve the right to correct any errors in product descriptions, prices, or availability. If there is a change to your order after purchase, you will be notified and given the opportunity to cancel or adjust your order, with a full refund if necessary.
Price and Payment

Accepted Payment Methods: We accept payment via most major debit cards, credit cards, PayPal, and in-store purchases via cash or card. Trail Explorer gift cards can also be used in-store or online.

Order Confirmation: The price of products displayed is the price you pay at the time of placing the order. Prices may differ between our online store and in-person store due to promotions, stock availability, or other factors.
Returns and Warranties

Returns: If you wish to return a product, you have 28 days from the date of delivery (for online orders) or purchase (for in-store purchases). The product must be kept in your possession and handled with reasonable care. Products must be returned in their original condition with all packaging intact. Returns are at your cost unless agreed otherwise.

Online Returns: Products returned by post must be shipped back at your own cost. Refunds will be issued within 14 days of receiving the returned goods in an acceptable condition.

In-Store Returns: If you are returning an item in person, it must be done within the 28-day period, and a proof of purchase is required. We will process the return and issue a refund based on the original payment method.

Warranties: If a product is faulty or does not meet the expected quality standards, you may be entitled to a warranty or replacement. Please contact us directly for assistance regarding any faulty products.
Order Cancellations

Online Orders: If you wish to cancel an online order, please notify us as soon as possible. Orders that have already been dispatched must be returned at your cost before a refund can be issued. Returns must be made in the same condition they were in when dispatched.

In-Store Purchases: For in-store purchases, we will assist with cancellations or exchanges if the product is unused and returned within 28 days, along with the original receipt.
Liability
Trail Explorer accepts no liability for products sold through our website or physical store that are sourced from third-party suppliers. We are not responsible for any damage, injury, or loss that may occur from the use of third-party products. Please use all products in accordance with the manufacturer's instructions.
Consumer Rights
Nothing in these Terms and Conditions will affect your statutory rights as a consumer. You have the right to a cooling-off period for online orders, where you can cancel the purchase within 14 days of receiving the goods, and return them for a full refund. This right does not apply to in-store purchases.
